Terms of service

These Terms of Service (“Terms”) govern your access to and use of www.ptal.in (“Website”) and the purchase of products offered through the Website.

The Website is owned and operated by Karshini Artysun Private Limited, operating under the brand name P•TAL (“P•TAL”, “we”, “us” or “our”).

By accessing the Website, creating an account, or placing an order with us, you agree to these Terms, together with our Privacy Policy, Shipping Policy, Refund/Return Policy and any other policies referred to on the Website.

If you do not agree with these Terms, please do not use the Website or place an order.

1. Eligibility

You must be legally competent to enter into a contract under applicable Indian law in order to place an order through the Website.

If you are below 18 years of age, purchases through the Website must be made by or under the supervision of your parent or legal guardian.

By placing an order, you represent that the information provided by you is true, accurate and complete.

2. Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms.

You must not:

  • use the Website in violation of any applicable law or regulation;
  • interfere with or disrupt the operation or security of the Website;
  • attempt to gain unauthorised access to any part of the Website or associated systems;
  • use automated tools to scrape, extract or harvest data from the Website without our prior written permission;
  • reproduce, sell, commercially exploit or redistribute Website content without authorisation;
  • upload or transmit malicious software, viruses or other harmful material;
  • impersonate another person or provide false or misleading information; or
  • use the Website in a manner that infringes the rights of P•TAL or any third party.

We may restrict or suspend access to the Website where reasonably necessary to protect our customers, systems, intellectual property or legal rights.

3. Accounts and Passwords

Certain features of the Website may require you to create an account.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Please notify us promptly if you believe your account has been accessed or used without authorisation.

4. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, materials, prices and other information displayed on the Website are accurate.

However, because many P•TAL products are handcrafted or hand-finished, minor variations in hammering, texture, finish, colour, dimensions, weight, patina or other aesthetic characteristics may occur from one piece to another.

Such natural variations are part of the handcrafted character of the product and will not ordinarily constitute a defect, provided that the product materially conforms to its description and is fit for its intended purpose.

Product colours may also appear slightly different depending on lighting, photography and screen settings.

Nothing in this section limits your rights in relation to goods that are defective, damaged, incorrectly supplied, materially different from their description or otherwise covered by applicable consumer law.

5. Legal Metrology and Statutory Product Information

Where applicable, products offered through the Website will display or be accompanied by information required under applicable Indian laws, including the Legal Metrology Act, 2009, the Legal Metrology (Packaged Commodities) Rules, 2011 and other applicable regulations.

Depending on the product and applicable requirements, such information may include details such as:

  • name and address of the manufacturer, packer or importer;
  • country of origin;
  • net quantity or number of units;
  • Maximum Retail Price (MRP), inclusive of applicable taxes;
  • month/year of manufacture, packing or import, where applicable;
  • consumer care/contact details; and
  • other declarations required by law.

In the event of an inadvertent discrepancy between Website information and a statutory declaration appearing on the product or its packaging, please contact us so that we can verify and rectify the information where necessary.

6. Orders

When you place an order, you are making an offer to purchase the selected products subject to these Terms.

An automated order confirmation or payment confirmation merely acknowledges receipt of your order and does not necessarily constitute final acceptance of the order.

An order may be accepted once it has been processed and/or dispatched by us.

We reserve the right to decline or cancel an order before dispatch in circumstances including:

  • product unavailability;
  • an obvious pricing or description error;
  • inability to verify payment or customer information;
  • suspected fraud or unauthorised transactions;
  • restrictions imposed by law;
  • inability to deliver to the specified location; or
  • circumstances beyond our reasonable control.

If we cancel a prepaid order, the amount paid for the cancelled product(s) will be refunded in accordance with our Refund Policy.

We will not cancel an accepted order arbitrarily or in a manner inconsistent with applicable consumer law.

7. Prices and Taxes

Prices displayed on the Website are in Indian Rupees unless otherwise stated.

Where required by applicable law, the displayed MRP will be inclusive of applicable taxes.

Delivery charges, additional services, engraving charges or other permissible charges, where applicable, will be disclosed before completion of the transaction.

Although we take reasonable care to ensure pricing accuracy, inadvertent pricing or typographical errors may occasionally occur. Where an obvious error is identified before an order is accepted or dispatched, we may contact you to offer the option of proceeding at the correct price or cancelling the affected product.

8. Payment

Payment may be made through the payment methods made available at checkout from time to time.

Payments may be processed by authorised third-party payment service providers. Your use of those payment services may also be subject to the terms and privacy practices of the relevant provider.

P•TAL does not guarantee that every payment method will remain available at all times.

If a transaction is unsuccessful but an amount is debited from your account, reversal or refund timelines may also depend on your bank, card issuer, payment gateway or other payment service provider.

9. Shipping and Delivery

Shipping availability, estimated dispatch times, delivery timelines, shipping charges and related terms are governed by our Shipping Policy.

Delivery timelines displayed on the Website are estimates unless expressly stated otherwise.

While we endeavour to deliver orders within the indicated timelines, delays may occasionally occur due to logistics providers, weather, strikes, government restrictions, natural events, high-demand periods or other circumstances outside our reasonable control.

Risk and responsibility for the product will pass in accordance with applicable law and the circumstances of delivery.

10. Cancellations, Returns, Exchanges and Refunds

Cancellations, returns, exchanges, replacement requests, damaged-product claims and refunds are governed by our Refund/Return Policy as displayed on the Website at the time of purchase.

Nothing in that policy or these Terms is intended to restrict any non-waivable right or remedy available to a consumer under applicable Indian law.

Where a product is received damaged, defective, incorrect or materially different from the product ordered, please contact us within the period specified in our Refund/Return Policy and provide the information reasonably required for us to investigate and resolve the issue.

11. Personalised and Engraved Products

Certain P•TAL products may be customised, engraved or personalised at the customer's request.

Please carefully check names, spellings, dates, initials and other personalised information before submitting your order.

Once personalisation or engraving has commenced, changes or cancellations may not be possible.

Personalised products may be excluded from returns or exchanges based solely on a change of mind, subject to our Refund/Return Policy.

However, this does not affect your rights where the item is defective, damaged, incorrectly personalised due to an error attributable to us, or otherwise required to be remedied under applicable law.

12. Product Care and Safe Use

Different metals, finishes and product categories may require specific care and usage practices.

You are responsible for following care, cleaning, seasoning, cooking and safety instructions supplied with the product or made available on the Website.

Certain materials may naturally oxidise, tarnish, darken, develop patina or change appearance with use. Such changes may be normal characteristics of the relevant metal and do not by themselves necessarily indicate a product defect.

For products containing tin lining, coatings, wooden components, glass, silicone or other materials, please follow the product-specific care instructions.

Products should only be used for the purposes for which they are intended.

13. Wellness and Informational Content

The Website may contain information relating to traditional practices, materials, cooking, Ayurveda, wellness, nutrition or the historical use of metals.

Such content is provided for general informational and educational purposes and should not be treated as medical advice, diagnosis or treatment.

Individual health requirements vary. Where you have a medical condition, allergy, dietary concern or other health-related question, you should seek appropriate professional medical advice.

Nothing in this section limits any representation that we are legally required to honour concerning a product.

14. Promotions, Offers and Discount Codes

Promotional offers, discount codes, gifts, contests or other campaigns may be subject to additional terms communicated at the time of the promotion.

Unless otherwise specified:

  • offers cannot be combined;
  • promotional codes may be restricted to specific products, order values, customer groups or periods;
  • offers have no cash value; and
  • we may refuse or cancel the misuse, manipulation or fraudulent use of a promotional offer.

We may modify or withdraw a promotion prospectively, subject to applicable law and without affecting orders already validly concluded under that promotion.

15. Intellectual Property Rights

Unless otherwise stated, all intellectual property rights in the Website and its content are owned by or licensed to P•TAL.

This includes, without limitation, trademarks, trade names, logos, product names, photographs, videos, text, artwork, graphics, packaging designs, website designs and other creative material.

You are granted a limited, personal, non-exclusive and non-transferable right to access and use the Website for personal and lawful purposes.

No content may be copied, reproduced, modified, commercially exploited, distributed or used to create derivative works without our prior written permission, except where permitted by law.

16. Reviews and User-Generated Content

Where the Website allows you to submit reviews, photographs, videos, comments or other content (“User Content”), you remain responsible for the content you submit.

You confirm that your User Content:

  • is truthful and relates to your genuine experience where presented as a review;
  • does not infringe intellectual property, privacy or other rights of a third party;
  • is not defamatory, unlawful, abusive, obscene or misleading; and
  • does not contain malicious code or unlawful promotional material.

By voluntarily submitting User Content for publication on our Website or social platforms, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and communicate that content for purposes connected with operating and promoting P•TAL, subject to applicable privacy and intellectual property laws.

We may moderate or remove User Content that violates these Terms or applicable law.

The Website may contain links to or integrations with third-party websites, payment providers, social networks, logistics providers or other services.

We are not responsible for the content, availability, privacy practices or independent conduct of third-party services that are not controlled by us.

Your use of such third-party services may be governed by their own terms and policies.

Your personal information is handled in accordance with our Privacy Policy and applicable data protection and privacy laws.

We endeavour to keep the Website accurate, secure and available, but we do not guarantee that access will always be uninterrupted or error-free.

To the maximum extent permitted by law, we disclaim warranties relating solely to the operation or availability of the Website that are not expressly provided by us or required by law.

This section does not exclude any warranty, guarantee, representation or consumer right that cannot lawfully be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, P•TAL will not be liable for indirect, incidental, special or consequential losses arising solely from your use or inability to use the Website where such losses were not reasonably foreseeable.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, wilful misconduct or any statutory liability or remedy available to consumers under applicable law.

Nothing in these Terms is intended to restrict your rights under the Consumer Protection Act, 2019 or any other applicable consumer protection law.

21. Indemnification

You agree to indemnify P•TAL against reasonable losses, liabilities or costs arising directly from:

  • your unlawful misuse of the Website;
  • your material breach of these Terms;
  • infringement by content submitted by you of another person's intellectual property or other legal rights; or
  • fraudulent or unlawful activity carried out through your account.

This provision will apply only to the extent permitted by applicable law and will not limit any statutory consumer right.

22. Events Beyond Our Reasonable Control

We will not be responsible for delay or failure to perform an obligation where such delay or failure results from circumstances beyond our reasonable control, including natural disasters, fire, flood, epidemic or pandemic restrictions, war, civil disturbance, governmental action, transportation disruption, widespread telecommunications failure or other comparable events.

Where such circumstances materially affect an order, we will take reasonable steps to communicate with you and provide remedies where required by applicable law.

23. Suspension or Termination

We may suspend or terminate access to an account where we reasonably believe there has been fraud, misuse, unlawful activity, security risk or material violation of these Terms.

Termination will not affect rights or obligations that arose before termination.

24. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, Website, products, services or applicable law.

The updated Terms will be posted on this page with a revised effective date.

Changes will apply prospectively and will not unfairly alter rights relating to orders already concluded, except where a change is required by law.

25. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary, without affecting the validity of the remaining provisions.

26. No Waiver

A failure or delay by us in exercising a right under these Terms will not constitute a waiver of that right.

27. Assignment

We may transfer or assign our rights and obligations under these Terms as part of a merger, restructuring, transfer of business or similar transaction, subject to applicable law.

You may not assign your contractual rights or obligations to another person without our prior written consent, except where such restriction is prohibited by applicable law.

28. Entire Agreement

These Terms, together with the policies expressly incorporated by reference, constitute the agreement between you and P•TAL in relation to your use of the Website and purchases made through it.

Nothing in this provision limits representations, warranties or rights that cannot lawfully be excluded.

29. Governing Law and Jurisdiction

These Terms and transactions conducted through the Website shall be governed by and construed in accordance with the laws of India.

Subject to any statutory rights and remedies available to consumers under the Consumer Protection Act, 2019 and other applicable laws, courts having jurisdiction in Panchkula, Haryana, India shall have jurisdiction in relation to disputes arising out of or relating to these Terms or the Website.

Nothing in these Terms restricts a consumer from approaching a competent Consumer Commission or other authority in accordance with the jurisdiction available to that consumer under applicable law.
